NATIONAL MINING LAW FORUM
I am pleased to have been asked to present at this year’s National Mining Law Forum on behalf of Legalwise Seminars, which will be held on Wednesday 11 September 2024. My presentation will be on Legal Due Diligence in the Mining Sector: The Current Merger and Acquisition Environment.

RECENT REGULATORY UPDATES
MINING AMENDMENT LEGISLATION IN WESTERN AUSTRALIA
On 12 June 2024, Hon David Michael MLA, the Minister for Mines and Petroleum, announced that the Government will be introducing legislative amendments to the Mining Act 1978 (WA) (“Mining Act”) to address key issues faced by industry.
NATURE POSITIVE PLAN AND CHANGES TO FEDERAL ENVIRONMENTAL LAWS
In October 2020, Professor Graeme Samuel AC released the ‘Independent Review of the EPBC Act – Final Report’ (“Independent Review”) which noted the increasing threat to the Australian environment and the failure of the Environment Protection and Biodiversity Conservation Act 1999 (Cth) (“EPBC Act”). The Independent Review also noted that business had suffered due to the complexity of the EPBC Act and the duplication of approvals processes.
NORTHERN TERRITORY MINING LEGISLATION REFORMS
The Northern Territory (“NT”) has had several mining legislation reforms come
into effect this month. The Mineral Titles Act 2010 (NT) (“Mineral Titles Act”) and Environment Protection Act 2019 (NT) (“Environment Protection Act”) have both seen amendments come into effect on 1 July 2024. Additionally, the new Mineral Royalties Act 2024 (NT) (“Mineral Royalties Act”) has commenced on 1 July 2024.
