Hetherington was excited to be this year’s sponsor of the Environment Award at the 2023 AMEC (Association of Mining and Exploration Companies) Awards Dinner held at the Optus Stadium in Perth on the 30th of November. Hetherington’s David Salim was pleased to be presenting this year’s award.

The Environment Award recognises the outstanding contributions made by a company, encompassing their environmental impact in relation to a variety of areas including land use, water management, community safety, on-going environmental impacts, mine closure and mine rehabilitation.

Regulatory Update – DMIRS

The Department of Mines, Industry Regulation and Safety (“DMIRS”) have recently announced a proposed an amendment to the Mining Regulations 1981 (WA) to introduce a prescribed fee for lodgement of objections under the Mining Act 1978 (WA). The fee proposed is a flat fee of $859.00 per objection, which is intended to apply from 1 July 2024. This comes are a result of the increasing volume of objections before the Warden’s Court, resulting in an increased cost to DMIRS, and delays in processing applications.

Submissions may be made in response to the proposed amendment to DMIRS by 5pm, 21 November 2023.

Regulatory Updates – Aboriginal Heritage Legislation Amendment and Repeal Bill 2023

On the 17 October 2023, the Western Australian State Government passed the Aboriginal Heritage Legislation Amendment and Repeal Bill 2023 (AH Repeal Bill). It is anticipated that the AH Repeal Bill will commence in November 2023.

There are two main effects of the AH Repeal Bill. First, to repeal the Aboriginal Cultural Heritage Act 2021 (WA) (ACH Act) and associated Regulations in their entirety, and secondly, to amend the Aboriginal Heritage Act 1972 (WA) (AH Act). The key amendments to the AH Act are as follows:

  1. Requirement to notify the Minister of new information regarding an Aboriginal site on land the subject of a consent (section 18(6));
  2. Native title party appeal rights in the State Administrative Tribunal (SAT) (section 18(5));
  3. Invalidating contracts or agreements which prohibit a native title party from making applications, commencing or being heard in judicial proceedings, or being heard or making submissions (section 18(5A));
  4. Premier ‘call in’ power for applications before the SAT of matters of State or regional significance (section 18A); and
  5. Notice requirements with change of ownership (section 18B).
