Regulatory Update – Aboriginal Cultural Heritage Act 2021 (ACH Act)
On the 8th of August, WA Premier Roger Cook, announced that the Aboriginal Cultural Heritage Act 2021 (ACH Act) has been repealed. After only 5 weeks of the legislation being in force, the Premier determined the legislation was too complicated and placed unnecessary burdens on property owners and industry. Western Australia will now revert to the previous Aboriginal Heritage Act 1972 with some conservative but important amendments to ensure the prevention of destruction or damage to Heritage Sites while creating a simpler and fairer system, which is more equitable for industry and traditional owners.
