On the 8th of August, WA Premier Roger Cook, announced that the Aboriginal Cultural Heritage Act 2021 (ACH Act) has been repealed. After only 5 weeks of the legislation being in force, the Premier determined the legislation was too complicated and placed unnecessary burdens on property owners and industry. Western Australia will now revert to the previous Aboriginal Heritage Act 1972 with some conservative but important amendments to ensure the prevention of destruction or damage to Heritage Sites while creating a simpler and fairer system, which is more equitable for industry and traditional owners.
The Hetherington team will be happy to assist you further and answer any questions you may have.
In our August edition of the Hetherington Post, we explore the results from the recent Fraser survey, discuss changes for the heritage clearance process for exploration and mining activities as a result of the repeal of the Aboriginal Cultural Heritage Act 1972 (WA), and provide a summary of the Tjiwarl Native Title Compensation Case.
The team at Hetherington attended a variety of industry events over the last couple of months. This edition discusses the key topics explored including how to prepare for compliance audits, and the regulatory developments that took place in South Australia in 2021.
Hetherington is also excited to be the Legal Sponsor at the upcoming MiningNews.net Select conference in Perth this September. To find out how to register for the event make sure to read the August 2023 edition of the Hetherington Post!
